One of my clients, Darren Murphy, came to see me, with his wife, Debbie, not knowing which way to turn. His previous accountant had decided that he didn’t want him as a client. The problem was that the accountant wouldn’t take any of Darren’s calls. Consequently he didn’t know which tax return had been filed and whether he and his brother had been set up as a partnership or not. I said to them that I would contact the accountant on their behalf and ask him for professional clearance5 and an update. The letter that came back stated: ‘We cannot provide any reasons why we resigned as accountants.’ This put doubt into my mind whether I should act as his accountant.

Now Darren was completely stuck — if he went to any other accountant, they would also be dubious about taking him on as a client. I decided to take him on. Now began the process of unravelling what had happened and what needed to be filed. I couldn’t, at this point, speak to HMRC as I wasn’t set up as an agent. Therefore, I had to brief my client as to the questions they needed to ask. We soon found out that both 10/11 and 11/12 tax returns were outstanding and that they had never been set up as a partnership. I knew that 10/11 was late but I was determined to get the 11/12 tax return filed on time. Working together with the client, being clear on what I needed, we managed to file the tax return on 30/01/13 — a day ahead of schedule!

By taking Darren Murphy on, it meant that they could move forward. Yes they have fines and penalties but they know where they are!
